Arizona planned communities are A.R.S. Title 33, Chapter 16, sections 33-1801 and following. Condominiums are Chapter 9. This page is the planned-community chapter. If your deed says condominium, use 33-1258 for records instead of 33-1805 and confirm the rest of the condo chapter.

Records

Section 33-1805 is unusually clear. All financial and other records must be made reasonably available for examination by a member, or by someone the member designates in writing. The association has 10 business days. It cannot charge you to look. Copies are capped at 15 cents a page. It may withhold attorney-client communications, pending litigation, and records of a session the open-meeting law did not require to be open, plus anything a privacy statute protects.

Name the documents. “All records since 1998” wastes the 10 days. The records letter is written for this kind of request. Cite 33-1805 in the first paragraph if you are in a planned community.

Meetings and resale

Section 33-1804 is the open-meeting statute: notice, agenda, and the topics that can be closed. A budget or a rule adopted with no agenda is worth a written objection and a request for the minutes.

Section 33-1806 covers what a buyer must receive when a home in a planned community is sold. The legislature has amended this section recently, including the list of disclosures and the fee cap. Read the current section on azleg.gov before you quote a dollar limit from memory. As of the 2026 text, the preparation fee is capped and a rush fee has its own cap. Confirm the numbers on the official page the week you are in escrow. The buying guide lists the questions those disclosures are meant to answer.

Common questions

I own a condo. Is 33-1801 the right chapter?

Condominiums are A.R.S. Title 33, Chapter 9, starting at section 33-1201. Planned communities, the subdivision HOAs, are Chapter 16, starting at 33-1801. Records rights exist in both. The section numbers are different.

How fast must they show me records?

Section 33-1805 gives the association 10 business days after a written request. Looking at the records is free. Copies cannot exceed 15 cents a page.
